CCPA Data Wiping

  • Under the California Consumer Privacy Act (CCPA), the “Right to Delete” requires businesses to securely erase personal information when requested by a consumer. As stated in California Civil Code § 1798.105(a): “A consumer shall have the right to request that a business delete any personal information about the consumer which the business has collected from the consumer.” Once such a verifiable request is received, organizations must also ensure that their service providers delete the data.
  • Failure to comply can lead to penalties – up to $2,500 per violation or $7,500 per intentional violation.

About CCPA Compliance

The CCPA applies to businesses that collect personal data of California residents and meet at least one of these criteria:

  • Have annual gross revenues of over $25 million
  • Buy, receive or share the personal data of 100,000 or more consumers, households or devices
  • Derive 50% or more of annual revenue from selling or sharing consumers’ personal data

In addition, service providers and contractors that process personal data on behalf of these businesses are also required to comply.
